Robert Queen (7.2 Deathmatch, 7.4 Kill on sight)

Recommended Posts

Player(s) being reported: Robert Queen @lenx
Date of rule breach: 15/09/2018
Time of rule breach: 11:20 AM GMT

Your characters name: Philip Malfitano
Other players involved: Everyone that may be seen in the video.

Specific rule broken:
7.2 Deathmatch
7.2.1 Deathmatch is the act of killing or hurting another player (or damaging their property) without a proper roleplay reason.
An attempt to break this rule will result in a temporary or permanent ban.

7.4 Kill on sight
7.4.1 Kill on sight (KoS) is the act of killing a player with no engagement in roleplay.

How did the player break the rule?: We were arguing over something really stupid in a report not too long ago and @lenx decided to show a clip that he thought
was going to benefit his friend. Unfortunately he uploaded a video where could be seen only a breach of Deathmatch and KoS rules. I've pointed that out in the prior
report, but @Marco Davis said and I'm quoting now, 'I am focusing on the original reason this report was made and not any other accusations as they will need to
be handled in a separate report.' With that being said, I've decide to create a separate report just like he told me to.
I'd like to point out that @lenx has already given us an explanation which could be seen in the report that was made by @Dieduks.

Evidence of rule breach:

Requesting @Marco Davis to handle this, because it's heavily associated with his prior report.

So let's look at it from my perspective. As i'm guarding my friend, a bunch of criminals with illegal weaponry roll up on us, moments later I hear shots coming from beside the van. What should I have done? What RP is left to perform? Walked up to the dude with a shotgun in front of me and politely ask that he doesn't rob my friend? Was I supposed to ask what his name was or who he was with? Hell no! The shooting had already started! Anyone that I did not know in that instance, became an immediate perceived threat to my life, so I did what I thought was necessary to preserve it. Which I did.

No, let's get back to reality and look at it from server rules perspective, rules that all of us must follow. I've read what you just said, I've read what you've said in the past and I could not notice that you're missing a point here. Don't worry, I'm here to help you out.

Since you were 'guarding your friend', let me ask you what did this guy do to you or your friend that you started shooting at him?

How about this guy? What did he do or said to you and your friend that got him killed?

How's any of these two murders falls under any of these categories?

7.2.2 Examples of valid reasons to attack another player:
• If they attempt to harm, hurt you or damage your property (or if they attempt to do the same to your friends or
allies), this also includes an attempt by the police to arrest someone;
• If they report you to the police for a committed heavy crime, however, if someone reports you for a light crime,
such as illegal parking, then the reason is insufficient;
• If they are not in compliance with the demands or if they attempt to escape or call other players for help;

7.4.3 KoS is allowed for these specific reasons:
• Your life was threatened in the past (ex.: in a robbery, a combat situation or a hostage situation);
• The life of your friend or ally is threatened at the present or if you have witnessed it happen in the past;
• There is an attempt to steal your valuables, or those of your group, if the value of theft is not less than $75.000
(this point excludes vehicles);

Anyone that I did not know in that instance, became an immediate perceived threat to my life, so I did what I thought was necessary to preserve it. Which I did.

That's a pure definition of Deathmatch.

His friend was shooting at my friend, for one. But for two, I certainly didn't want him getting off that bike and shooting me with the shotgun which is clearly visible on his back. So I shot at him to get him to leave or at least go somewhere where im not at a disadvantage.

Again, his friend was shooting at my friend. He also had a shotgun, so the last thing I wanted was to be shot by it.

That's also a pure definition of Deathmatch.

In the context of pretty much any other situation you might be right. But the difference is, we know you. Fog City Crew has been messing with us for some time, so it's not like you were some random people to me. I knew who you were and what your intentions were.

That's not a reason to shoot somebody.

Stop trying to take the context of of the situation. I did not shoot first. You guys all had shotguns on your backs, you were wearing the same colors, and you were all on motorcycles. It was OBVIOUS that you were together, even if i didn't already know that you were Fog. Once the shooting started, it was us vs you. If i was shooting at just random vehicles and people that went by, you'd have a case. But, I was shooting at the men with illegal shotguns on their backs. Regardless of whether you think they were a threat in that video, I can tell you I felt that they were a very real threat while it was happening.

Stop living in your unicorn world. You keep mentioning 'heavy guns' and 'illegal shotguns' like that means something. Just because you see a guy on a bike with a shotgun on his back, it's not a valid reason to kill or even shoot him.

First off all, I don't care about your feelings, I'm more concerned about facts. Let me ask you again, how did any of these two people posed any kind of threat to you or your friend?

I understand why you pointed a gun in a tense situation like this, I just can't understand why did you pull a trigger. The only thing that Mask 4347_5036 did was walking. There was no warnings from your side nor orders given for him to stop, you just opened fire. Mask 9976_7869 is a bigger mystery to me, I was hoping you'll be able to explain it, unfortunately you can't.

Let me give you an example which might help you to understand why and where you are making a mistake. Let's say there's 20 people and one of them or even two of them start shooting. That doesn't mean I can kill all 20 just because I think that they're friends.
